Former BP Agent Sentenced to 20 Years in Capital Murder Case

BROWNSVILLE, Texas - We now know the fate of a former border patrol agent involved in a capital murder case.
This morning a judge sentenced Joel Luna to 20 years in jail.
Luna was on trial for the murder of a Honduran man during Spring Break of 2015.
State prosecutors believed that Luna and his brothers had a criminal empire.
A jury found Joel Luna guilty of engaging in organized criminal activity. 

We spoke to lead defense attorney for the former agent who believes his client should have been tried separately. Carlos Garcia, the defense attorney representing Joel Luna says, “We believe that trying them together was terribly prejudicial. We believe that it affected the jury’s outcome or determination in this case… We don’t agree with the jury’s verdict but we respect their verdict.”

The 20 year sentence was agreed upon by the defense and prosecution.
Part of that agreement was that Joel Luna would not appeal the ruling.
We also find out that Eduardo Luna, the brother sentenced to life in prison, has filed an appeal to have his case heard before a judge once more.
